trial without pleadings

A procedure in the High Court that may be ordered for any action in which the defendant has given *notice of intention to defend other than one in which there is a claim for libel, slander, malicious prosecution, false imprisonment, or an allegation by the plaintiff of fraud. The court must be satisfied that the issues can be defined without pleadings or that the case is otherwise suitable and it may order the parties to prepare a statement of the issues in dispute. Such orders are rarely made.
