tenancy in common

Equitable ownership of land by two or more persons in equal or unequal *undivided shares. Each co-owner may sell or dispose of his share by will, and a share does not pass automatically by the right of survivorship on the death of a co-owner but forms part of his estate (compare *joint tenancy). Under the Law of Property Act 1925 the legal estate is held by the co-owners as joint tenants on trust for themselves as equitable tenants in common, and a *trust for sale is implied.
