resale price maintenance

The fixing by a supplier of the price at which his goods may be sold by others. This may be attempted by contractual arrangements or by nonlegal means, such as blacklisting by trade associations. Resale price maintenance is now regulated by the Resale Prices Act 1976, under which the collective enforcement of price maintenance agreements is illegal. Provisions in contracts of sale between suppliers and dealers fixing minimum prices are void except when an exemption has been granted by the *Restrictive Practices Court. Contractual provisions fixing maximum prices may, under certain circumstances, be enforced against a third party who purchases the goods with notice of the provision.
