1. The referral by a court of a case (or an issue arising in a case) to another court or an arbitrator (referee) for a decision or opinion. In the High Court any action or any question or issue of fact arising from it may be referred to an *official referee for trial. In the county courts, a case may be referred to the registrar for an opinion and report. Under the EEC Treaty, a court may refer to the *Court of Justice of the European Communities a question of Community law for a preliminary ruling and must do so if it is a court from which there is no appeal within the national system.
