rectification of will

Under the Administration of Justice Act 1982, a court has power to rectify a will that fails to carry out the intentions of the testator. However, this only arises when the court is satisfied that the failure was caused by clerical error or through a misunderstanding of the testatorís instructions. An application for rectification should as a general rule be made within six months from the date on which *representation was first taken out.
