reckless driving

The offence of driving a motor vehicle on a road in such a way as to create a real risk of causing physical injury to other road users or fairly substantial damage to property (see *recklessness). Cyclists can commit a similar offence. Guilty motorists are punishable summarily with up to six months’ imprisonment and/or a fine of up to £2000 and on indictment with up to two years’ imprisonment and/or a fine. Reckless driving requires a *notice of intended prosecution. It is normally subject to *endorsement and under the *totting-up system carries 10 penalty points; it is also subject to discretionary *disqualification. See also *offences relating to road traffic.
