nemo est heres viventis

[Latin: no one is the heir of a living person]
A maxim stating that a personís *heir can be ascertained only at the time of his death, since until then his heir apparent may die or be disinherited. Thus an heir apparent has no legal or equitable interest in property he expects to inherit until it actually devolves upon him.
